GENERAL TERMS OF USE


ART. 1 - PURPOSE

“COCA | CENTER OF CONTEMPORARY ARTISTS” announces the 3nd international edition of the contest for the realization of artistic production. “COCA Project 2021” is aimed at the promotion and enhancement of contemporary art.

ART. 2 - ARTIST PROFILE

“COCA Project 2021” is open to all adult artists of any nationality, who are project partners or new project members of the COCA | CENTER OF CONTEMPORARY ARTISTS association.

ART. 3 - ARTISTIC SKILLS

Each artist can present works on any support / material, even already published works, the artist must be alive. To the finalist artists, who want to realize the artistic residency and the exhibition, will be requested additional information material and available works. The works have no size or duration limits.

ART. 4 - ADVISORS: THE JURY

The selection of candidates will be carried out by an international jury selected by COCA | CENTER OF CONTEMPORARY ARTISTS. The Advisors will have professional profiles connected to the world of art and economics to analyze and evaluate both the creative aspect and the related budgets of the submitted projects".

ART. 5 – RECOGNITIONS AND AWARDS

The international jury will award recognition to all COCA | CENTER OF CONTEMPORARY ARTISTS members:

WINNER: ARTISTIC PRODUCTION FUNDING

The realization of artistic production of the maximum value of 5,000 euros.The sum requested will be paid for services such as accommodation, food, travel, various materials, technology and software, equipment rental, space rental, human resources useful for the realization of artistic production.

Furthermore, the artist will participate in an exhibition in Grottaglie (Taranto, Italy) in The House of Collectors.

121 FINALISTS | 11 EXHIBITIONS

The finalist artists will be selected by the advisors of the COCA Project and viewed by The House of Collectors, they will have the maximum visibility of their online profile on cocaproject.art, and 11 (eleven) artists among the finalists will be selected for an exhibition in Italy in Grottaglie (Taranto) in the house of THC to promote to Italian collectors their works selected by COCA .

3 ARTISTIC RESIDENCES

Three artists among the finalists will be selected to be hosted in artistic residences and where they can use the CRAFT LAB of the Pino Pascali Foundation. The 2021 location is Grottaglie (Taranto, Italy), historic city of European ceramic culture and contemporary art. The goal is to create conceptual and / or real artistic works and to contaminate various disciplines. Artists of all artistic abilities can participate in the residences. Accommodation for 10 days and the exhibition of the works produced will be financed.

SELECTED ARTISTS:

The profiles of the artists of the 1st and 2nd selection will be published online on cocaproject.art and promoted through all COCA marketing channels.

The exhibition of the artists and the artistic residences will take place by 2021, currently due to COVID-19, COCA has not defined a calendar. The artistic residencies will be agreed with the artists. The transport costs of the works for the exhibition are borne by the artists.

ART. 6 - OPEN CALL MODE

FREE PRE-REGISTRATION

Artists can submit their project for free by March 2nd, 2021 or, when the number of 121 finalist artists will be reached, exclusively by completing the online form (link) available on the website cocaproject.art.

SELECTION MODE

The selection by the Advisors will take place in 4 phases, and the results will be progressively updated online on the website www.cocaproject.art in real-time:

  • FREE PRESELECTION
  • 1st SELECTION
  • 2nd SELECTION
  • 121 FINALIST ARTISTS

The Advisors, in case of need for modifications or clarifications regarding the submitted projects, will be able to contact the artists through e-mail or video calls. The decisions of the Advisors are final and unquestionable.

REGISTRATION OF SELECTED ARTISTS

Only the artists SELECTED by the Advisors will be able to terminate the registration to COCA2021 by paying the annual membership fee and must be performed through the PayPal service. The fee of 47 euros includes membership of the COCA association and partial coverage of organization expenses. The artists must keep a copy of the payment. The registration fee is in no way refundable.

CALENDAR

The Advisors will judge the selections in real-time. The COCA2021 schedules are as follows:

Application deadline: March 2, 2021

Publication of the artists of the 1st selection and selected artists: in real-time.

Finalist artists will be published by April 7, 2021.

Winner presentation: April 25, 2021.

The art exhibition and artistic residencies will take place by 2021, currently due to of the COVID-19, the organization has not defined a calendar pending further information. The transport costs (round trip), insurance and any charges regarding the artist's works exibition will be the responsibility of the artists, the organization will coordinate the entire exhibition by creating private invitations to collectors, national and international art lovers and art galleries.

ART.7 - VISIBILITY OF ARTISTIC PROFILES

The selected artistic profiles and the finalists will be visible on the website www.cocaproject.art. with a fixed-term personal portfolio. Here are some examples of artistic portfolios of artists participating in the second edition of COCA2020: https://cocaproject.art/coca-2020/

ART.8 - INTELLECTUAL PROPERTY

The ownership of the works presented will remain with the participating artists, the COCA PROJECT will use video and photographic materials only to promote the artists during the exhibitions, on the association's website / social site and through email to promote the works.

ART.9 - CONSENT - TERMS AND CONDITIONS

Participation in the open call implies the knowledge and total acceptance of the General Terms of Use and the European Regulation information (GDPR 2016/679) and of this Regulation and the COCA | CENTER OF CONTEMPORARY ARTISTS Statute.

ART.10 - ORGANIZER

The "COCA | CENTER OF CONTEMPORARY ARTISTS" association is the "COCA20" Organizer.

ART.11 - GENERAL TERMS OF USE

C.O.C.A | CENTER OF CONTEMPORARY ARTISTS adopts a strict policy to protect the e-mail addresses and personal data of its users. The e-mail address used for registration will never be displayed on www.cocaprize.art, or on the online profile of the artists or in communications with other users, or in administrative e-mails. C.O.C.A | CENTER OF CONTEMPORARY ARTISTS undertakes not to disclose e-mail addresses to third parties in its mailing services and not to sell them to any person or company. By using this website, the user is obliged to accept the following conditions of use. The owner and organizer reserves the right, at his discretion, to modify, add or re-move parts of these terms at any time, as well as adding or removing users from the site, whether they are paying users or non-paying users. Please check these terms periodically. The continued use of the website after posting changes to these terms implies acceptance of such changes, even if changes are made after registration. The original announcement of the COCA is in Italian; therefore, other translations will only be used as an example: in any case and circumstance the Italian version will have priority over any other kind of translation.

"Each artist contributes to “COCA20“, project by COCA | CENTER OF CONTEMPORARY ARTISTS, without any consideration, the rights of reproduction, exhibition, publication, translation and communication to the public, of all the materials published by him at the time of registration.

THE “COCA2021”, a project by COCA | CENTER OF CONTEMPORARY ARTISTS may disclose, for any reason and in any way, the materials in full respect of moral copyright law. "

ART.12 - RESPONSIBILITY

“COCA2021”, project by C.O.C.A | CENTER OF CONTEMPORARY ARTISTS, invites artists-members to subscribe to the newsletter and to periodically consult the site www.cocaproject.art to be informed of all updates and any changes made to this announcement. The winning artist will be entrusted with a tutor / advisor who will assist him during the course of the activity. To this end an agreement will be signed between the two parties for the development of artistic production that will be carried out according to an agreed timetable.

ART.13 use of materials

"Unless otherwise indicated, all texts, images and videos entered by members registered on the websites of C.O.C.A | CENTER OF CONTEMPORARY ARTISTS (www.cocaproject.art or other sites managed by the association), now called websites or website, are protected by copyright, but are automatically licensed to C.O.C.A CENTER OF CONTEMPORARY ARTISTS which may be used for promotional purposes in catalogs or in other activities of the center or its franchised organizations. In particular, all artworks presented at the final exhibitions of any prize organized by C.O.C.A | CENTER OF CONTEMPORARY ARTISTS will remain visible online as historical documentation and therefore cannot be removed. Even photographic material, CDs, DVDs, curricula vitae and any texts or catalogs presented by the artists for the purposes of their application, will not be returned, but archived by the organizer. The contents of the website can not in any way be reused without the permission of the user who placed them and the Organizer."

ART.14 - RESPONSIBILITIES FOR CONTENT

"People who in their own right or on behalf of others, insert texts, images or videos on the websites of C.O.C.A | CENTER OF CONTEMPORARY ARTISTS , they will have full responsibility for it. The Organizer reserves the right to remove defamatory, slanderous and obscene texts; images that may violate the rights of third parties or that may constitute civil or criminal liability or violate the law, except for cases motivated by the artists."

ART.15 - CHILDREN & MINORS

The website is only for adults (older than 18 +). The display of the contents of the website by minors is the sole responsibility of their parents, guardians or those who are in responsible for their care.

ART.16 - PRIVACY

"The registration data and some other demographic information and personal data provided are subject to the privacy rules of the organizer according to art. 13 of Legislative Decree no. 196/2003. Information related to Italian legislation: personal data will be used to send the requested information. Data can be used in electronic transmission.

The consent to their use, without which it will not be possible to receive the requested information, is optional. Personal data will not be disclosed to third parties, nor will they be transferred, if not in compliance with the law and only for reasons related to predetermined obligations. The publication of visible online data, including personal data, is the responsibility of the users and cannot be considered as violation of users’ privacy by the Organizer.

All data and images inserted on the site are granted to C.O.C.A | CENTER OF CONTEMPORARY ARTISTS, which is responsible for their treatment. The acceptance and the modalities of the use of personal data and of the rights related to the art.6 of the above mentioned legislative decree are to be considered implicit in the request for information and participation in the activities foreseen on the websites’ platform of C.O.C.A | CENTER OF CONTEMPORARY ARTISTS.

Each candidate expressly authorizes “COCA2021”, C.O.C.A | CENTER OF CONTEMPORARY ARTISTS project, as well as their direct delegates, to process personal data transmitted according to Legislative Decree no. 196/2003 (Privacy Code). This is also for the purpose of inclusion in databases managed by the above-mentioned people."

ART.17 - INDEMNIFICATION

You agree to indemnify, defend and hold the Organizer out of all responsibility, loss, claim and expense, including legal fees, related to a violation or alleged violation of this agreement or use of the websites.

ART.18 - JURISDICTION

"The websites are owned by the Organizer and are managed by offices in Italy. The Organizer does not guarantee that the contents posted by users on websites are appropriate or available for use in other countries. Those who choose to access the website from other locations do so on their own initiative and are responsible for establishing the usability or correctness of any information or content in any or all jurisdictions and the compliance of such information or content with local laws, if and to the extent that these are applicable. Any controversy arising from the application of this agreement, including the application of privacy legislation, is governed by Italian law on the subject."

ART.19 - DISCLAIMER

"The Organizer, including its officers, directors, employees and agents, are not responsible for any incorrect or imprecise content published on the websites, either by users, members or any equipment or program associated or used in the service, or for the conduct of users and / or members of websites both online and offline. The Organizer assumes no responsibility for errors, omissions, interruptions, deletions, defects, delays in operation or transmission, failure of communication lines, theft or destruction or unauthorized access, or alteration of the user profile, their account and / or communication of members. The Organizer is not responsible for problems or technical malfunctions of networks or telephone lines, online computer systems, servers or providers, computer equipment, software, e-mail service, due to technical problems or traffic congestion on the Internet or on any website or combination, including injury or damage to users and / or members or computers of any other person connected or arising from the participation or downloading of materials in connection with the websites. The Organizer cannot guarantee and does not promise any specific result from the use of the websites."

ART.20 - LIMITATION OF LIABILITY

"Except in jurisdictions where these provisions are limited (and in cases where liability is declined to the maximum extent permitted by law), under no circumstances will the Organizer be liable to the user or third parties for any indirect, consequential damage, exemplary, incidental, special or punitive, including loss of profits deriving from the use of the websites, even if the Organizer has been informed of the possibility of such damages.

The user also agrees not to hold the Organizer accountable, including his officers, directors, agents, subsidiaries and employees for complaints arising if the profile of another user ends up being offensive, harmful, inaccurate and / or misleading.

Even if in these ‘Conditions of use’ is reported something that contradicts what follows, the responsibility of the Organizer for any cause and for any legal action will always be limited to amount paid by the user, if paid, to the Organizer for the service during the registration to the site."

ART.21 - NOT LEGAL ADVICE

The content of the website has been prepared by the Organizer as a service to its users and the Internet community and is not intended to constitute legal material. The organizer has used all reasonable efforts to collect, prepare and supply quality information and material, but does not guarantee the accuracy, completeness, adequacy or topicality of the information contained or linked to the website. Those who use the information taken from the website or link do so at their own risk.

ART.22 - OTHER PRODUCTS

"Any reference made by the websites for any specific commercial product, process or service (or supplier of such product, process or service) in commercial name, trademark, hyperlink, or other, does not constitute or implies approval, recommendation or suggestion from part of the Organizer.

The content of websites can be provided by third parties and users. All opinions, advice, statements, services, offers or other information expressed or made available by third parties, including information providers, users or others, are the own responsibility of the author or distributor and do not necessarily reflect the ideas of the Organizer."

ART.23 - LINKS TO OTHER WEB SITES AND SERVICES

To the extent that the websites contain links to external services and resources, the Organizer does not check the availability and content of these external services and resources. Any questions and requests for clarification, regarding services or external resources, or any link to them, must be addressed to the specific service or resource.

ART.24 - TO UNSUBSCRIBE FROM NEWSLETTER
